Terms of service
1 · Who we are
KindBid is a white-label charity auction platform operated as an initiative of Crowdera. Your contracting entity depends on your market:
- India: Bharat Crowdera Ventures Pvt Ltd
- Singapore: The Crowdera Solutions Pte Ltd
- United States & Rest of World: The Crowdera Solutions Inc
Receipt facilitation, where offered, involves our philanthropic partners: Crowdera Foundation (India, a Section 8 nonprofit company) and Crowdera Foundation (Delaware, USA, a 501(c)(3)).
2 · Organizations are the merchant of record
Organizations running auctions on KindBid are the merchant of record for their lots. Winning-bid payments and GiveForward donations flow to the organization through our payment partners' connected accounts; KindBid provides the technology, payment orchestration and receipt tooling. Organizations are responsible for the accuracy of their listings, their tax-receipt eligibility, and fulfilment of won items.
3 · Accounts and bidding
You sign in with a one-time email code and must save a payment method before your first bid. A bid is a binding commitment: when an auction closes, the winner's saved payment method is charged the winning amount automatically. Bids cannot be withdrawn; see the auction rules for increments, soft close and fair-play requirements.
4 · The GiveForward Pledge
When you bid with the GiveForward Pledge active, you authorize a donation to the organization if you are outbid, at your chosen percentage of your highest bid on that lot (within the range the organization configured). You can change your percentage or opt out any time before the lot closes, from your account page. Collection timing depends on the organization's configured mode: Mode A charges pledges when the lot closes; Mode B (where enabled) collects the pledge at bid time and credits it against your payment if you win.
5 · Fees
KindBid charges organizations a platform fee under their contract with us. Fees are never added on top of a bidder's bid or a donor's donation — the amount you commit is the amount you pay.
6 · Receipts and tax treatment
Receipts follow the organization's market: 80G receipts in India, IPC tax-deduction receipts in Singapore (where the organization holds IPC status; standard receipts otherwise, which carry no deduction), and 501(c)(3) contribution receipts in the United States. For winning bids, the deductible portion is the amount paid above the item's declared fair market value; organizations attest that value. Nothing on KindBid is tax advice — consult your advisor.
7 · Refunds
All transactions are final. Refunds apply only to payment-gateway errors or confirmed fraud. Refund requests go to the organization you supported, as merchant of record; KindBid retains an administrative override for confirmed fraud or processing error.
8 · Suspension and prohibited use
We may suspend accounts or organizations that break the auction rules, list prohibited items, misrepresent their status, or misuse the platform. Suspension freezes publishing and bidding; it never erases donor records or issued receipts.
9 · Liability
KindBid provides the platform “as is” during beta. To the maximum extent permitted by law, our aggregate liability for any claim is limited to the platform fees received by us for the auction giving rise to the claim. We are not a party to the sale between organization and winner.
10 · Changes
These terms are versioned (currently v1); pledge consents record the version in force when you bid. We will notify account holders of material changes, and continued use after notice is acceptance.
